I feel something is wrong here.
The artist who drew the image is Jerry Bennet, and the shirt originally sold on Teefury.com. The ebay selling is just reselling what they bought there. Technically a mashup like this would be considered a parody and is therefore free game.

I knew of it a long while back, but didn’t know they licensed a shirt for it. Not that ebay is known for legal stuff or anything, but I thought it was a case of fan art being used in sale without artist being aware.
